1. Scope

The following General Terms and Conditions apply to all deliveries from the sw-trading business division of Xtrason GmbH to the consumer (§13 BGB).

SW Trading is a certified online shop and complies with the requirements provided for by Trusted Shops (available at www.trustedshops.de).

3. Offer and conclusion of the agreement

The presentation of our products in our Online Shop does not constitute a legally binding offer, but it is rather an invitation to place an order. All offers are valid subject to the „while available“ principle , unless otherwise indicated for the items in question. Errors excepted.

By clicking on the “Order” button of the final step of the order process, you place a binding order, registered in the shopping cart. The confirmation of receipt of the order takes place immediately after placing your order. The purchase comes with our order confirmation or delivery of goods.

4. Right of revocation, cancellation policy, consequences

The consumers (§13 BGB) have a legal right to cancel the order.

Cancellation right

You may cancel your purchase contract within two weeks without providing reasons in written form (e.g. fax, email). or – if you are delivered the goods before the deadline - by returning the goods. The time limit starts upon the receipt of this note in writing, but not before the goods are delivered with the recipient (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before our obligations undertaken under § 312c Section 2 BGB as per § 1 sections 1, 2 and 4 BGB-InfoV as well as our obligations in accordance with § 312e section 1 clause 1 BGB
as per § 3 BGB-InfoV are fulfilled. To ensure the period of revocation the timely sending of the revocation or the object suffices.

Consequences of revocations

In the case of an effective cancellation the performances received by both parties and if required the uses taken advantage of (e.g. interest) must be returned. In case the goods received cannot be returned entirely or in parts or only in a worsened state you are required to pay damages to us insofar as required. This does not apply to the handing over of objects if the deterioration of the object only results from its inspection - the way in which you may have been able to detect the deterioration in a shop. For the rest you may avoid the obligation to compensation in that you do not use the object as if it was your property and avoid everything that impairs its value.

Items that may be shipped shall be returned at our own risk. Returns must be appropriately stamped.  In case of claims or returns of objects whose worth exceeds 40 EUR, we shall refund the return postage costs. Objects, which may not be sent in packages, will be collected from your house.

Obligations to reimburse payments shall be fulfilled within 30 days. For you, the period of revocation begins when you send the revocation request or the items in question and for us, it begins once we receive the goods.

5. Prices and shipping costs

The prices of the products displayed in the shop include VAT and other price components but do not include the transport or shipping costs and neither do they include customs or other additional duty.

In addition to the stated prices, we charge delivery costs in accordance with the delivery cost specifications below.

For cash on delivery payments, an additional fee of 6.00 € shall be charged. (see delivery cost table)
For COD deliveries shipped, upon your request, with DHL, an additional fee of 2.00 € shall be charged and collected by the local DHL/post courier. No further fees are to be charged.

You shall be informed once again about the shipping costs on the product page, in the shopping cart system and on the order site.

6. Delivery

In , the regular delivery time is 1-2 business days. Delays or different delivery times shall be stated on the product page.

Should we not be able to  deliver the ordered product in due time, because of a delay in the delivery from our suppliers, you shall be informed about the situation immediately. If this is the case, you may choose to wait for the ordered product or to cancel the order. In case you decide to cancel your order, any payment already made shall be refunded to you.

7. Payment

With us, you may choose to pay by prepayment (bank transfer), cash on delivery, direct debit, by credit card or on invoice. In case you choose to pay by bank transfer, we shall  provide our bank details in the order confirmation and  the merchandise shall be dispatched once payment is confirmed. 
Our claims may be offset solely against demands, in favour of which legal judgement has been passed or which we are informed upon in writing. You may exercise your right of detention of the goods only if your claims result from the same s from the same contractual relationship.

8. Proprietary rights

The goods remain our property until all outstanding payments are settled.

9. Warranty

The warranty is subject to legal provisions. For all the goods that develop defects during the statutory two year warranty from the delivery date, you are entitled to ask for a rectification of the defects (your choice between: remedy of the defects or a new delivery) and – in accordance with the statutory provisions- you have the right to a deduction or cancellation as well as to a compensation.  We are entitled to two damage remedy attempts. Should your choice of defect rectification imply unreasonable costs for us,   your choice of rectification shall be limited to the other possibility.

10. Data protection

We use the information we collect from you in order to place and carry out your order.  Also, we forward the relevant information to the delivery company responsible with the shipment of your order   (name, address, possibly phone number in order for a delivery time to be set). Your data shall also be passed onto our bank in order to settle outstanding payments. Your personal data shall not be supplied to third parties, nor will it be used for marketing purposes.  Once your order is fulfilled and all outstanding payments are settled, the access to your personal data is blocked and once the term of the tax and commercial law provisions expire, they are deleted. 

You have the right to free access to the personal data we stored, and to the right to rectify, block or delete such data. 11. Other information

Ordering process
When you find the product you want, you can add it to your shopping cart by clicking the  “Add to shopping cart” button. You can check the content of your shopping cart anytime by clicking on the “Show shopping cart” button.

The products can be removed from the shopping cart by clicking the “Remove” button. If you wish to purchase the items in your shopping cart, click the “Buy” button. Then, please enter your data in the fields of new window that will open up. The mandatory fields are marked with an *.  A registration is now required. Your data is encrypted. Please double-check  your data after you enter it.
The order process is complete once you click on the “Order” button.  The process can be interrupted at any time by closing the browser window. You will get more information (e.g. correction possibilities) on the individual sites.

The contract text shall be saved in our internal system.  The terms and conditions can be viewed on this page at any time. The order details as well as the general terms and conditions shall be sent to you by e-mail.  You can view your order information in our customer login area.
